INFORMATION ON THE PROCESSING OF PERSONAL DATA

Under Section 19(1) and 2 of Act No. 18/2018 on the Protection of Personal Data and on the Amendment of Certain Acts, if personal data relating to a data subject is collected from him or her, the Operator is obliged to provide the data subject with the following information when collecting it:

Legal basis for the processing of personal data:

  • Section 13 (1) (b) of Act No. 18/2018 Act on the Protection of Personal Data and on the Amendment of Certain Acts: “the processing of personal data is necessary for the performance of a contract to which the data subject is a party or for the performance of a pre-contractual acts based on the request of the data subject”
  • legitimate interest of the operator (camera system)

RIGHTS OF THE DATA SUBJECT

Data subjects whose personal data is processed by the Operator have the following rights:

  • Request from the operator access to personal data relating to the data subject The data subject has the right to obtain confirmation from the operator as to whether personal data concerning him or her is being processed. The Operator is obliged to provide the data subject with his/her personal data that it processes. For the repeated provision of personal data requested by the data subject, the operator may charge a reasonable fee corresponding to the administrative costs.
  • The right to rectification of personal data. The data subject has the right to have the operator rectify incorrect personal data concerning him or her without undue delay. With regard to the purpose of the processing of personal data, the data subject has the right to have incomplete personal data completed.
  • Right to personal data portability The data subject has the right to obtain the personal data concerning him or her that he or she has provided to the operator, in a structured, routine manner in a common and machine-readable format and has the right to transmit such personal data to another operator, where technically feasible.
  • The right to withdraw consent at any time, if it has been granted
  • The right to lodge a complaint with the Office for Personal Data Protection
  • The right to object to the processing of personal data If the personal data is processed unlawfully, the reason for its processing has ceased to exist, or the data subject has withdrawn his/her consent to the processing of his/her personal data, the data subject has:
  • The right to erasure of personal data
  • The right to restriction of processing of personal data

In order to demonstrate compliance with the Act, the Operator is obliged to process personal data in accordance with the principles set out in Sections 6 to 13 of the Act and to comply with the information obligation.

  • Purpose limitation principle
    The Operator obtains personal data only for a specifically determined, explicitly stated and legitimate purpose and does not further process it in a manner that is incompatible with this purpose;
  • The principle of minimization of personal data
    The personal data processed is adequate, relevant and limited to the necessary extent given by the purpose for which it is processed.
  • Principle of correctness
    The Operator makes every effort to ensure that the processed personal data is correct and, if necessary, updated
  • Retention minimization principle
    Personal data is stored in a form that enables the identification of the data subject for as long as it is necessary for the purpose for which the personal data is processed; Personal data is stored for a longer period if it is to be processed exclusively for the purpose of archiving
  • Principle of integrity and confidentiality
    Personal data is processed in a manner that guarantees adequate security of personal data through appropriate technical and organizational measures, including protection against unauthorized processing of personal data, unlawful processing of personal data, accidental loss of personal data, deletion of personal data or damage to personal data.
  • Principle of responsibility
    The Operator is responsible for compliance with the basic principles of personal data processing, for the compliance of personal data processing with the principles of personal data processing.
  • Principle of legality
    The Operator processes personal data only in a lawful manner, i.e. on a specific legal basis and in such a way that the fundamental rights of the data subject are not violated.

The Operator fulfils the information obligation by applying Section 19(1) and 2 of the Act, by providing the Data Subject with the following information when collecting personal data relating to the Data Subject:

  • identification data and contact details of the operator and the operator’s representative, if authorised,
  • the contact details of the Data Protection Officer, if appointed,
  • the purpose of the processing personal data for which the personal data is intended, and also the legal basis for the processing of personal data,
  • the legitimate interests of the operator or of a third party, if the personal data is processed on this legal basis (under Section 13(1)(f));
  • the identification of the recipient or the category of recipient, if any;
  • the period of storage of personal data; If this is not possible, information on the criteria for its determination
  • whether the provision of personal data is a legal requirement or a contractual requirement or a requirement that is necessary for the conclusion of a contract, and whether the data subject is obliged to provide the personal data, and also the possible consequences of non-provision of personal data
  • about any authorized processor who processes the personal data of the data subject on behalf of and on the basis of the instructions of the operator

The Operator also fulfils the information obligation by providing data subjects with information about their rights:

  • the right to request from the operator access to personal data relating to the data subject,
  • the right to rectification of personal data,
  • the right to erasure of personal data
  • the right to restrict the processing of personal data,
  • the right to object to the processing of personal data,
  • the right to personal data portability,
  • the right to withdraw consent at any time, if it has been granted,
  • the right to lodge a complaint with the Office for Personal Data Protection.

The Operator observes confidentiality under Section 79 of the Act.
The Operator has authorised and instructed persons who process personal data under the conditions at the Operator.
